The right of the EU citizens, the family members of a citizen of the Republic of Lithuania to permanent residence in Lithuania

The EU citizens, who arrive to live in Lithuania together with a citizen of the Republic of Lithuania as his/her family members, are granted the right to permanent residence in Lithuania. They are deemed to have arrived together if a citizen of the Republic of Lithuania resided in a foreign country together with his/her family members and they all move to reside in Lithuania. A family member who arrives to reside in Lithuania together with a citizen of the Republic of Lithuania and who is an EU citizen, if he/she wants to receive a certificate for the right of the EU citizen to permanent residence in Lithuania, shall submit to the Migration Division of the Territorial Police Office the following:

  1. an application of established form;
  2. a valid travel document (a passport or the Identification Card);
  3. A free-form application of a citizen of the Republic of Lithuania to issue a certificate to his/her family member to confirm the right of the EU citizen permanent residence in Lithuania;
  4. documents certifying that a citizen of the Republic of Lithuania had left Lithuania to reside in a foreign state if he/she had not declared that he/she was leaving Lithuania in the procedure established by the Law on Declaration of the Place of Residence;
  5. Documents certifying that the EU citizen is a family member of a citizen of the Republic of Lithuania:
    • A document certifying his/her marriage or an agreement of registered partnership and/or
    • documents certifying that the EU citizen is a family member of a citizen of the Republic of Lithuania, his/her spouse or a person with whom a citizen of the Republic of Lithuania has concluded an agreement of registered partnership;
    • a direct descendant under the age of 21, or
    • a direct descendant who is a dependent and submits documents certifying his maintenance, or
    • is a dependent relative in a straight ascending line (parents, adoptive parents, grandparents) and submits documents certifying his/her maintenance;
  6. in case the state’s charge for the issuance of a certificate is paid for the EU citizen by another person, an extended form of a payment order, which shall contain the name, surname and the personal code or the date of birth of the EU citizen, together with the bank stamp.

The EU citizen who arrives to live in Lithuania together with a citizen of the Republic of Lithuania, who has exercised the EU right of free movement, and who is not a legal family member though he/she can prove that he/she maintains de facto marriage relationship with that citizen of the Republic of Lithuania, also acquires the right to permanent residence in Lithuania.

“A citizen of the Republic of Lithuania is deemed to have exercised the EU right of free movement if he/she resided in another EU Member State after 1 May 2004 (i.e. he was not on holiday and did not go to do the shopping in another EU Member State but was engaged in some activities (worked, studied, etc.) and maintained relations with that country.”

In this case the concept of the family is extended and the EU citizen who arrived to reside in Lithuania together with a citizen of the Republic of Lithuania who has exercised the EU right of free movement seeking to obtain a certificate to confirm the right of the EU citizen to permanent residence in Lithuania, must submit to the Migration Division of the Territorial Police Office the following:

  1. an application of established form to issue a certificate certifying the right of the EU citizen to permanent residence in Lithuania;
  2. a valid travel document (a passport or the Identification Card);
  3. a free-form application of a citizen of the Republic of Lithuania to issue a certificate to the EU citizen to confirm the right of the EU citizen to permanent residence in Lithuania;
  4. documents certifying that a citizen of the Republic of Lithuania resided in another EU Member State after 1 May 2004 if he/she had not declared that he/she was leaving Lithuania in the procedure established by the Law on Declaration of the Place of Residence (a document issued by another EU Member State certifying the right to reside in that state, employment contracts, bank statements, residential rent agreements, contracts for the provision of services, etc.);
  5. documents proving that the EU citizen is another person who exercised the right of free movement of persons according to the EU legal acts:
    • documents certifying that the EU citizen is a cohabitant of a citizen of the Republic of Lithuania with whom he/she maintains stable relationship for the past three years (e.g., common residential rent or a loan agreement on purchasing a dwelling, birth certificates of their children), or
    • documents certifying that the EU citizen is maintained by a citizen of the Republic of Lithuania, or ,
    • documents certifying that the EU citizen maintains a common household with a citizen of the Republic of Lithuania (e.g. a common residential rent or loan agreement to purchase a dwelling), or
    • documents certifying that due to serious health problems the EU citizen desperately needs personal care of a citizen of the Republic of Lithuania (e.g., a certificate issued by a medical institution).
  6. If the personal data of the EU citizen is at variance with his/her personal data in the Register of Aliens  and/or the Residents’ Register of the Republic of Lithuania, – documents certifying a change in the personal data (civil status registration certificates,  the court decision to restore, supplement, change or correct the entry in the Civil Status Act and others);
  7. if the state charge for the issuance of a certificate for the EU citizen has been paid by another person – the extended form of the payment order, which contains the name, surname and the personal code or the certificate of birth with a bank stamp of the EU citizen instead of who the payment has been made.

The validity period of the certificate certifying the right of the EU citizen to permanent residence in Lithuania is not specified.
